Terms of Inflatable Equipment Rentals

Lessor and Driver(s) Requirements: To rent a GoBoat or iSUP, the Lessee named on the Rental Agreement must be at least 19 years old. The primary Lessee must present a valid G driver’s license (not a learner’s permit) in person at the time of rental. All additional users must also meet the age and licensing requirements mentioned above. Additional drivers must present their driver's license in person and be present for driving instruction to be eligible to operate our rental watercrafts.

Compliance with Regulations: Lessees and Drivers must adhere to the rules and regulations set forth by the Canadian Coast Guard. The consumption of drugs or alcohol is strictly prohibited on our watercraft. Lake & Land Rentals reserves the right to refuse rental to anyone suspected of being under the influence of drugs or alcohol.

Safety Equipment: Lake & Land Rentals does not provide safety equipment required for each vessel, but the Lessees has the option to for rent. It is the Lessees responsible to provide own safety gear as indicated by Transport Canada's Marine Safety regulations,  ensure the legality and safety of the personal watercraft.

Boater Education Recommendations: While not mandatory, we highly recommend that the Lessee and all Drivers obtain a pleasure craft operator's card before renting. Visit www.boatsmartexam.com for information on the Boat Smart course and exams. If you do not possess a boater’s license (pleasure craft operator's card), you may complete a boater safety checklist (Canadian Coast Guard Approved), which serves as a temporary license for the duration of the rental.

Cancellation Policy and Weather Safety

Cancellation Notice: We request a minimum of 48 hours' notice for any rental cancellations. Our rental day commences promptly at 9:00 am. If you cancel your booking with more than 48 hours' notice, your Non-Refundable Booking Deposit will be securely held in your Lake & Land Rentals customer account. This deposit can be conveniently applied to any future rental invoice.

Late Cancellations or No-Show: Failure to notify us at least 48 hours before 9:00 am on the first day of your rental, or providing no notice at all, will result in the forfeiture of your booking deposit.

Weather Safety Concerns: In the event of unsafe weather conditions, as determined by Lake & Land Rentals staff (including sustained high winds or lightning), we reserve the right to refuse the rental. Our primary concern is your safety while out on the water. However, we understand that rescheduling may be necessary. If your rental is refused due to unsafe weather conditions, we will happily reschedule your booking to another day. Your booking deposit will be seamlessly applied to the alternate rental day.

Rescheduling Policy: Rescheduled rentals are subject to equipment availability. We strive to accommodate all rescheduling requests; however, we do not cancel other customers' rentals to accommodate alternate rental days. We appreciate your understanding in this matter.

Deposit Validity: Booking deposits for customers who reschedule 48 hours or more ahead of their rental do not expire. You can rest assured that your deposit remains valid and can be applied to rentals in the following year as well.

Damage Deposit and Responsibility

Damage Deposit Requirement: At the commencement of the rental, a damage deposit is pre-authorized on the Lessee's credit card. This is a mandatory requirement for all rentals and is contingent upon the type of rental being conducted.

Deposit Size: The amount of the damage deposit varies based on the specific rental being undertaken.

Late Return Charges

Policy: A Late Charge based on the full daily rate will be enforced if the rental is returned after the specified return time indicated on the Rental Agreement.

Release of Liability and Waiver Agreement

Any and all rentals from Lake and Land Rentals (“Company”) come with an inherent risk to life and well-being. In signing this Liability and Waiver Form, the Participant releases the Company from any and all liability resulting from the above.

This Release of Liability and Waiver Agreement ("Release") is made and provided by the person signing below ("Participant") to participate in the rental of any equipment from the Company ("Activities"), a Province of Ontario corporation, and for other good and valuable consideration, Participant agrees to all Terms set forth in this Agreement. Participant acknowledges that entering into this Release is required as a condition to participating in the Event. The Effective Date of this Release is on the date of its execution and delivery by Participant.

1. Assumption of Risk. Participant understands and is aware that the Activities involve inherent risks, dangers, and hazards. Participant may sustain serious injury, including but not limited to temporary or permanent disability, paralysis, death, and property damage. Such risks and dangers may be caused by the Participant's own actions or inactions, the actions or inactions of others who are also participating in the Activities, the condition of the Property, adverse weather conditions, or the negligence of the Company, its affiliates, and their respective directors, officers, employees, agents, representatives, shareholders, successors, and assigns ("Releasees"). PARTICIPANT VOLUNTARILY AND FREELY ASSUMES ALL RISKS, DANGERS, AND HAZARDS THAT MAY OCCUR PURSUANT TO PARTICIPATING IN THE ACTIVITIES, INCLUDING THE RISK OF INJURY, DEATH, OR PROPERTY DAMAGE, WHETHER CAUSED BY NEGLIGENCE OF THE COMPANY OR OTHERWISE.

2. Participant's Representations. Participant acknowledges and represents that: (1) Participant is qualified to participate in the Activities; (2) Participant will at all times wear the safety gear standardly required for the activity at hand (for example: a life-jacket, when participating in the rental of water equipment); (3) Participant will not consume or be under the influence of any alcohol or drugs at any time of participating in the Activities; (4) Participant is not pregnant, (5) Participant will ensure that any guest under the age of eighteen (18) is accompanied by a parent, custodian, or guardian, (6) Participant has fully read and understands each of the provisions of this Release and acknowledges that the Participant is voluntarily waiving substantial legal rights, including the right to sue the Company and the Releasees, and (7) Participant, if renting any equipment from the Company, which individuals other that the Participant intend to use, is voluntarily and freely assuming all risks, dangers, and hazards that may occur pursuant to participating in the activities, on behalf of the Participant’s guests, including guests of all ages, including those guests under the age of eighteen (18).

3. Release from Liability. Participant hereby agrees to waive and release any and all claims which Participant has or may have in the future against Company and the Releasees arising from the participation of the Activities for any injury, temporary or permanent disability, death, damages, liabilities, expenses, costs, and/or causes of action, now known or hereinafter known in any jurisdiction in the world, whether caused by the negligence of the Company, the Releasees, or by any other reason. Participant acknowledges and agrees that this Release is a complete release of any responsibility of the Company and the Releasees for any injury, temporary or permanent disability, death, damages, liabilities, expenses, costs, and/or causes of action sustained by the Participant while participating in the Activities.

4. Indemnification. Participant agrees to indemnify, defend, and hold Company, along with Releasees, harmless from and against any third party claims, losses, liabilities, damages, expenses, and costs, including reasonable outside attorneys' fees and court costs, to the extent arising out of the Participant's participation in the Activities, whether or not arising out of the Company and its Releasees (1) negligence or willful misconduct; (2) violation of applicable law; or (3) material breach of any of the Terms of this Release.

5. No Duty to Supervise. Participant acknowledges and agrees that they are aware that the Company and the Releasees have no duty to supervise the Activities of the Participant. The Releasees assume no responsibility or liability for the acts or omissions of the Company, the Releasees, or any such related persons.

6. Entire Agreement. This Release is the entire agreement between the parties with respect to the subject matter hereof and supersedes any prior agreement or communications between the parties, whether written, oral, electronic, or otherwise. Except as expressly provided in this Release, there are no representations, warranties, conditions, other agreements or acknowledgements, whether direct or collateral, express or implied, that form part of or affect this Release.

7. Governing Law. This Release shall be governed by, and construed and enforced in accordance with, the laws in force in Province of Ontario, excluding any conflict of laws rules or principles which might refer such construction to the laws of another jurisdiction. The Parties hereto agree to submit to the exclusive jurisdiction of the courts of the Province of Ontario and waive any objection relating to improper venue or inconvenience forum to the conduct of any proceeding in any such court.

8. Severability. In the event that any term or provision, or any portion of a provision, of this Release is held to be invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Agreement.
